This Privacy Policy was last modified on and is effective as of 27 July 2015.

1. Introduction

Animoca Brands Limited (together with its parents, subsidiaries, affiliates, agents, representatives, consultants, directors, employees and officers, collectively, “Animoca Brands”, “we”, or “us”), among other things, operates the crowd source platform, Animoca Brands Ideas at http://ideas.animocabrands.com/ (“Platform”) and provide other related services (together with the Platform, “Services”). We take our users’ (“users” or “you”) privacy rights seriously.

This Privacy Policy explains how we collect, use, store, disclose and manage the personal information (“Personal Information”) you provide to us when using the Platform and Services. Whenever you access or use the Platform and any of the Services, you agree to allow us to collect, use, store, disclose and manage your Personal Information as explained in this Privacy Policy, and accept the terms and conditions of this Privacy Policy.

We have the right to amend this Privacy Policy from time to time. Use of your information we collect now is subject to the Privacy Policy in effect at the time such information is used. Whenever you use the Platform or Services, please check this Privacy Policy to make sure that you are aware of any amendments in our privacy practices. The date our Privacy Policy was last updated will be displayed therein. We will post a revised policy on the Platform to inform you and other users if we make any material revisions to this Privacy Policy. You understand that you accept the amendments to our Privacy Policy by continuously using the Platform or Services.

This Privacy Policy should be read along with our Terms of Services posted at http://ideas.animocabrands.com/pages/terms-of-service-1 together with all other rules, policies and procedures and additional terms and conditions published on the Platform (all of which are incorporated by reference) which governs your use of the Platform and Services. Capitalized terms, if not defined in this Privacy Policy, are defined in the Terms of Services.

IF YOU CHOOSE NOT TO ACCEPT THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT USE THE PLATFORM OR ANY OF OUR SERVICES.

2. What Personal Information We Collect and How We Collect them

In order for you to set up an account on and/or use the Platform or Services, certain Personal Information may be collected and processed by us, which may include:

  • information (such as your name and email address) that you provide by completing the user account set up forms on the Platform;

  • your login and password details, in connection with the user account set out process;

  • your Facebook or Google information if you are signing up through Facebook Connect or Google +, respectively, and such information will include your public profile, friend list and email address. For Facebook Connect, we collect you public profile information, which includes your name, profile picture, age range, gender, language, country and other public info, and your email address. For Google +, we collect your public profile, which includes your full name, profile picture and profile URL, and your email address. We use the collected information to authenticate your identity, display your number of friends on your profile page, show you Funding Ideas that your friends have funded, and link your Facebook or Google + profile information to your Platform account. Facebook Connect further gives you the option to post information about your activities on the Platform to your profile page to share with others within your friend network.;

  • details of any requests or transactions you make through the Services;

  • information about your activity on, and interaction with, the Platform such as your IP address and the type of device or browser you use; and

  • communications, comments, contributions to discussions, messages or questions you send to us.
    If you are a contributor to the Funding Idea, the following information will be further collected from you:

  • your name, email address, ship-to information, billing name and address, your Paypal email address (if any);

Please also note that the following information about you may be publicly viewable on the Platform:

  • your account name and its creation date;

  • any information you add to your profile;

  • any Voting Ideas for which you have voted;

  • any Funding Ideas to which you have contributed; and

  • any comments that you have posted on the Platform.

Please note that each Idea page lists the community of users who have voted for or contributed to the Idea. If you do not want other users to see your name on such lists, please choose an account name that is inconspicuous.

3. How Personal Information Are Used

We may use your Personal Information collected from you in various ways, which include but not limited to the followings:

  • register you as a user of the Platform and identify you when you sign in to your account;

  • operate, maintain and manage the Platform and Services;

  • provide advertising and promotional information in connection with the Platform and Services;

  • present ideas to you when you use the Platform or Services which we believe will be of interest based on your geographic location and previous use of the Services;

  • administer your account with us or funds;

  • prevent fraud or potentially illegal, unethical or legally actionable activities, and enforce the Terms of Services;

  • provide to government or law enforcement officials to protect our rights and property as well as those of third party and protect the safety of the public or any person;

  • provide technical support and allow us to respond to any question you make through the Platform;

  • solicit your feedback and input to improve the Platform and Services, including the Platform, products and Services and personalize your user experience, diagnose problems with our server and develop new product and services;

  • analyze the use of the Platform and Services and the people visiting to improve our content, the Platform and Services; and

  • use for other purposes that we may disclose to you when we request your information.
    We do not post anything to your Facebook, Twitter, or other third-party accounts without your consent. In addition, we do not receive or collect credit card details or other payment information of users who contribute to the Funding Ideas.

We will use commercially reasonable efforts to promptly notify you if any of your Personal Information is compromised. However, we do not accept liability for any unintentional disclosure or a disclosure that occurs due to a security breach of our systems or facilities.

4. How Your Personal Information Are Shared With Third Parties

We may share your Personal Information with third parties only in the ways that are described in this Privacy Policy. We do not and will not sell your Personal Information to other third parties.
We may share your Personal information in the following ways, which includes but not limited to:

• prevent fraud or potentially illegal, unethical or legally actionable activities, and enforce the Terms of Services;

• in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity or provide such Personal Information to government or law enforcement officials as required by law or as we believe reasonably necessary to protect our rights and property as well as those of third party and protect your safety as well as those of the public or any person; and

• with any other user, contributor, or third party with your prior consent to do so as described in this Privacy Policy.

If we are involved in a merger, acquisition, or sale of all or a portion of our assets or bankruptcy, you will be notified through email and/or a prominent notice on the Platform of any change in ownership or uses of your Personal Information, as well as any choices you may have regarding your Personal Information.

5. How and Where Personal Information Are Stored, International Transfer and Personal Information Security

We are an international organization and your Personal Information we collect or receive are stored in data storage facilities in different locations. For instance, if you are located outside Hong Kong and choose to provide information to us, we may transfer your Personal Information to Hong Kong and processes it there and your submission of such information represents your agreement to that transfer. We may use, transfer to, process or hold such information by computers located in other countries, including countries outside your country of residence or governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction, and used for the purposes set out in this Privacy Policy.

We may use third parties service providers for the collection, processing and storage of your Personal Information in the data storage servers and/or equipment owned and operated by such third parties, and such third parties will comply with our Privacy Policy and to use your Personal Information only for the purposes for which they have been engaged by us. We are not responsible for these third parties’ acts and omissions, except as provided by the applicable laws. Please note that other countries’ data protection laws may not be the same as those of your country of residence or governmental jurisdiction. You hereby consent to the transfer, storage and processing of your Personal Information as mentioned in this section.

We also understand that it is important to keep your Personal Information safe and secure. We follow generally accepted standards to protect your Personal Information submitted to us, both during transmission and after we receive it. Commercially reasonable security measures to safeguard and secure your Personal Information and to prevent the destruction, loss, misuse and alteration of such information under our control have been implemented by us. We do not believe that there is any transmission method over website or Internet that is completely flawless, even though our commercially reasonable security measures have been put in place against possible breaches of our sites’ security and our user records and databases. We are not liable for data loss, hacking, unauthorized access or other breaches in relation to our servers and systems or guarantee the security of user account information. You transmit your Personal Information to our sites at your own risk. After we receive your information, we have procedures and security measures in place to attempt to prevent any unauthorized access. You also have the obligation to limit access to your computer (or other device) and browser by logging out after you have finished accessing your account to ensure that there is no unauthorized access to your account and Personal Information.

Identity theft and the practice currently known as "phishing" are of great concern to us. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your user account information, or login password in a non-secure or unsolicited email or telephone communication.

6. Policies Regarding Children Under The Age of 13

We recognize the obligation to protect Personal Information obtained from young children. The Platform or Services are not geared toward children under the age of 13 and we do not knowingly collect or solicit any Personal Information from such children. If you are between the ages of 13 and 17, please use the Platform or Services only after obtaining your parent/legal guardian’s parental consent. If you are under 13, please do not use the Platform or Services, or send any of your Personal Information to us. If we find out that we have collected Personal Information from a child under the age of 13, we will remove such information as soon as practicable. If you believe that we may have collected any Personal Information from or about a child under the age of 13, please contact us at the contact information below.

7. Links To Other Third Party Sites’ Privacy Policies

Our sites, the Platform or Services may contain links to websites of other third parties that we do not own or have any control. It does not mean that we authorize, sponsor or endorse those third parties, nor is it a representation of our association with them, when we provide such links to other websites. If you click on such links, including clicking on a banner ad or other type of advertisement, you will leave our site and will be directed to those third parties’ sites. As we do not have any control over such third parties’ activities, we are not responsible for their websites’ content or privacy practices, the collection or use of your information or any of their products or services. We cannot provide assurance that such third parties employ the same or similar privacy and security practices as us. We strongly advise you to carefully read and review such other websites’ privacy policies, as their privacy policy governs any information you provide to such third parties. Only information collected on or through the Platform or Services is subject to this Privacy Policy.

The Services may also contain other third party service providers’ tracking tools. We may use such third parties’ APIs/SDKs in providing the Services to you, which may allow these third parties to analyze user information. Although these third parties may have access to your Personal Information when services are performed for us, they may not use such information for any purposes other than to provide their services.

The Platform also includes Social Media Features, such as the Facebook Like button and Widgets, such as the Share this button. These features may collect your IP address, which page you are visiting on the Platform, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on the Platform. Your interactions with these Features are governed by the privacy policy of the company providing it.

8. English Language

The English version of this Privacy Policy governs. All disputes, claims and causes of action (and related proceedings) will be communicated in English.

9. Your Access and Options

You may refuse to submit your Personal Information to us; however, in that case, you will not be able to become a user or use certain features of the Platform or Services.

If you change any of your Personal Information, you may correct, update, amend, remove, or ask to have it removed by contacting the email address listed below. If you decide not to continue with the Services, you may choose to delete your account through the “Settings” page, or contact us directly.

We will retain your Personal Information for as long as your account is active or as needed to provide you with the Services. We will retain and use your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

10. Notifications and Opt-Out

You consent to our using your email address to send you Platform/Services-related notices, including any notices required by law, in lieu of communication by postal mail. You may not opt out of some Platform/Services-related communications. You can change the frequency of many Platform/Services-related communications by contacting us.
